Wisconsin’s abortion-supporting attorney general, Josh Kaul, is planning for a future in which the U.S. Supreme Court overturns Roe v Wade. He has stated he won't investigate or prosecute violations of an abortion ban if Roe is overturned.
Gracie Skogman of Wisconsin Right to Life, reacting to Kaul's statement, says the state is in a “uniquely powerful position” to defend the unborn if Roe is overturned.
“Due to our stand on abortion,” she says, “that we have on the books that have been unable to enforce.”
That is a reference to an abortion ban passed in 1849, which has not been enforced for a half-century and which requires the attorney general to enforce it.
If Roe is overturned, Skogman says Wisconsin Right to Life will work to get Kaul to enforce the law. If he refuses, the group will urge attorneys step up and defend the unborn.
There is also an election coming up, she says, in the fall of 2022.
